Togo: Fumbling With a Digital ID While Actively Surveilling Citizens

For four years Togo has been inching towards issuing a digital identity (ID) card. While there are indications that 2022 may be the year in which the west African country finally delivers the long-awaited digital ID, the road ahead remains uncertain. Challenges lie both in bureaucratic delays and citizens’ caginess about handing their data to a government with a penchant for surveilling citizens and shutting down digital communications.

The Togolese government announced the e-ID Togo project in 2018, but it was not until mid 2021 that the Ministry of the Digital Economy and Digital Transformation initiated efforts to recruit a communications consultant to devise an awareness campaign to precede the registration stage and a technology solutions service provider. The International Institute of Information Technology Bangalore was awarded the system contract in December 2021.

According to the government, the e-ID project will simplify the process of updating the electoral register, facilitate access to public services and to credit, reduce fraud in the financial sector, and facilitate the targeting of social protection beneficiaries. Only 25% of the country’s population of eight million has a form of identification, with women less likely to have an identification document, which hinders their ability to open bank accounts, enrol children in school, benefit from health insurance, or get a mobile phone number. In recognition of the gaps in civil registration among citizens, the government set out to enrol citizens for e-ID even without proof of birth registration.

Togo passed Law No. 2019-014 relating to the protection of personal data in October 2019. In 2020, parliament passed Law No. 2020-009 relating to the biometric identification of natural persons, whose objective is to establish a system for identification and authentication of natural persons. The law aims to establish a “secure and reliable methodology” for obtaining, maintaining, storing and updating data on the identity of registered individuals. The law requires all citizens and residents in Togo to obtain a Unique Identification Number (NIU) by submitting their demographic and biometric data (Article 4). The biometric data specified for purposes of obtaining a NIU are photograph and / or facial recognition, fingerprints, and iris scan. The National Identification Agency (ANID) is mandated to collect biometric data for the NIU.

SIM Card Registration
In July 2021, a SIM card registration and limitation of subscriptions per individual and network campaign was launched by the telecommunications regulatory authority ARCEP, supported by leading telecom operators Moov Africa Togo and TogoCom. The SIM registration requirements include a national identity card or passport and collection of biometric and demographic data. 

But this extensive collection of individuals’ personal data raises concerns for the safety of such data. These concerns are not unfounded and they partly arise from the state’s record on respect for digital rights, which have seen it order network disruptions and use malware to target opponents and dissidents.

State Surveillance
In 2020, lingering suspicions that the Togolese government was undertaking interceptions of communications gained credence when the Citizen Lab revealed that Israeli-made spyware Pegasus, supplied by the NSO Group, was used between April and May 2019 to target Togolese civil society, including a Catholic bishop and a priest, as well as two members of Togo’s political opposition. The surveillance reportedly coincided with nationwide pro-reform protests that were forcibly dispersed. The Togolese government did not respond to the allegations, which nonetheless sparked debate within Togolese media and civil society.

Further, in October 2021, Amnesty International research found that Togolese activists had been targeted with spyware by the Donot Team hacker group based in India – the  first time that Donot Team spyware was found in use outside of South Asia. According to the report, the activists’ devices were targeted between December 2019 and January 2020, during a tense political climate ahead of the 2020 presidential election.

Network Disruptions

During the February 2020 elections, authorities disrupted access to messaging services (WhatsApp, Facebook Messenger, and Telegram). Later that year, the Economic Community of West African States (ECOWAS) Court of Justice ruled that the 2017 internet shutdown in Togo was illegal and an affront on the right of freedom to expression. 

According to Access Now, the court ordered the government of Togo to pay two million francs (USD 3,459) to the plaintiffs as compensation, and to take all the necessary measures to guarantee the implementation of safeguards with respect to the right to freedom of expression of the Togolese people.

Privacy and Data Protection

Togo’s laws provide safeguards against unlawful surveillance and unauthorised access to data whilst also granting authorities sweeping powers to violate privacy. Law No. 2012-018 on electronic communications provides for privacy of communications but article 92 empowers the Prime Minister, and the Ministers responsible for the economy and finance, defence, justice, and security and civil protection, to trigger the interception of communications and electronic content.

The biometrics identification law requires the National Identification Agency to encode and encrypt data on its registry and only allows access to authorised agents (article 10, 21 & 22). Violation of the obligation of non-disclosure of personal data, identity theft and unauthorised processing of personal data are punishable with fines ranging from one million to 10 million Central African Francs (USD 1,747 to 17,472), imprisonment between one and five years, or both.   

Article 94 of Togo’s 2012 electronic communication law obliges encryption service providers to comply with lawful interception orders, with refusal to provide secret decryption codes to government agencies punishable with a fine of between USD 3,544 and USD 14,178. Cryptology services providers are required to retain for one year, content and data allowing the identification of anyone who has used their services, and to provide the technical means that enable the identification of those users. The service providers are required to avail this data, on request, to the investigating judge, Prime Minister, Minister for the Economy and Finance, the Minister of Defence, the Minister  of Justice, and the Minister of Security. The multiple officials who access data – similar to the various officials that can trigger the interception of communications – offers wide latitude for abuse of citizens’ data privacy rights.

Digital Exclusion
In the wake of Covid-19, Togo initiated a relief programme for vulnerable citizens whose livelihoods were affected by the state of emergency. As at March 2021, the programme, known as NOVISSI, had disbursed a total of 13.3 billion francs (USD 22 million) to 819,972 citizens via mobile money.

However, the programme was criticised for requiring applicants to possess a voter’s ID card. During the last electoral census, opposition parties called on the population to boycott the exercise, which meant that some citizens had not renewed their voter ID cards. There were also cases of unscrupulous individuals utilising the voter’s ID details of other citizens to fraudulently benefit from the programme. As a result, the government temporarily halted the program to allow for physical verification of beneficiaries at dedicated centres.

Way forward

Whereas the various sanctions within the existing legal framework might be a deterrent against unauthorised access to and misuse of personal data, there is wide latitude for state agencies and officials to access the data, which could be abused. This calls for a review of the provisions to ensure they uphold citizens’ right to privacy and data protection, with adequate oversight and redress mechanisms. Further, the e-ID should be rolled out in a manner that ensures agency and dignity, without enhancing exclusion and surveillance. 

Tech to the Rescue Against Covid-19: Reflections from West Africa

The role of technology in aiding the Covid-19 fight in Africa is increasingly undisputed. As Covid-19 cases have grown in Cote d’Ivoire, Ghana and Togo, governments and the private sector have played a decisive role in the three countries’ technology-based response measures, with large scale national efforts to minimise the social-economic impact of the pandemic.

In Ghana, in the wake of the pandemic, the Ministry of Health partnered with the Ministry of Information to leverage websites, USSD short codes, toll free lines, alongside broadcast media to share with the citizenry information on the virus spread and response management measures. The government also rolled out utility (water and electricity) subsidies and reduced from 9% to 5% the communications service tax as part of its relief interventions. Telecommunications operators also supported the fight against Covid-19, with MTN and Vodafone supporting distance learning with zero-rated access to education content for subscribers.

In Togo, in a move to promote cashless transactions, telecommunications operator Moov waived fees on mobile money transactions and payments for utilities. Meanwhile, the Association of Volunteers for the Promotion of Youth (AV-JEUNES) launched a mobile application which provides reliable information on Covid-19, practical advice and awareness videos in French and four additional local languages. Initially intended to provide sexual and reproductive health information to youth, women and vulnerable populations, the platform known as eCentre Convival has supported the fight against misinformation and helped educate pregnant women and young people about the coronavirus. In the telecommunications sector, service providers rolled out reduced price offers and doubled internet speeds.

Meanwhile,  partly to fight the spread of false and misleading information on the virus, Orange Cote d’Ivoire launched a media platform to allow print, online and broadcast media to keep abreast of its Covid-19 response and relief measures. MTN and the Ivorian government partnered to support data-driven decision making in the fight against the virus. Like in Ghana, MTN Cote d’Ivoire waived mobile money transaction fees and subsidised internet services. As part of social-economic relief strategies, the Ivorian government announced a grace period for utility service payments.

These examples from the three countries point to a variety of ways in which governments, telecommunications operators and innovators have ensured service continuity, promoted digitalisation and access to reliable information in the face of Covid-19 lockdown restrictions.

Indeed, an opinion assessment through an online survey and interviews conducted by the author among 42 individuals, indicated that online platforms including social media were the primary means through which citizens in the three countries stayed informed during the pandemic. However, whereas there have been efforts to provide content in local languages, English and French remained predominant, excluding illiterate segments of the population.

As stated by one respondent, “the exponential growth of online platforms in the wake of Covid-19 will have a powerful effect on the digital economy, enabling business and the public sector to explore new service offerings, with significant efficiency gains.” The respondent added that with a supportive policy and legislative environment, alongside infrastructure roll out and more local language options, across the three countries, “entire sectors and traditional business models, whether in the field of transport, hospitality or automotive industry will be transformed.”

Good News, Bad News: A Story of Internet Shutdowns in Togo And Ethiopia

The pushback against internet shutdowns in Africa received a boost last month when the Economic Community of West African States (ECOWAS) Community Court of Justice ruled that the 2017 internet shutdown in Togo was illegal. This followed another win just over a year ago when, in January 2019, the Zimbabwe High Court ruled that the state-initiated internet shutdown that same month was illegal.

However, barely a week after the ECOWAS ruling, Ethiopia  initiated a nationwide shutdown, thus serving a reminder of the persistent threat of internet shutdowns on the continent. Ethiopia has a history of repeated network disruptions, including during national high school exams, but mostly as a means to stifle public protests. Prior to the latest disruption, last year a 10-day nationwide disruption was initiated following the assassination of six top government officials.

The latest disruption comes on the heels of protests triggered by the murder of Hachalu Hundessa, a popular musician and democracy activist. Between January and March 2020, millions of Ethiopians in the western Oromia region were similarly disconnected from the internet and were in the midst of a government-imposed shutdown of internet and phone services and thus could not readily access information, including Covid-19 news.

Ethiopia’s shutdown also bears some traits with the Togolese shutdown of 2017, which was initiated following the announcement of planned anti-government protests by members of the opposition and resulted in internet access being disrupted during September 5–11, 2017. In 2019, the digital rights advocacy group Access Now led a coalition of eight organisations, including CIPESA, in filing an amici curiae (friends of the court)  brief in a lawsuit filed by Amnesty International Togo and other applicants.

The ruling by the ECOWAS court acknowledges that the internet shutdown, in addition to being illegal, was also an affront on the right of freedom to expression, echoing a 2016 resolution by the United Nations on the promotion, protection and enjoyment of human rights on the internet. Further, Access Now reports that the court ordered the government of Togo to pay two million CAF (USD 3,459) to the plaintiffs as compensation, and to take all the necessary measures to guarantee the implementation of safeguards with respect to the right to freedom of expression of the Togolese people.

In both Ethiopia and Togo, old habits die hard. Last February, when Togolese citizens went to vote, authorities disrupted access to messaging services (WhatsApp, Facebook Messenger, and Telegram) on election day after the polls had closed. The disruption was imposed despite the call by local and international rights groups urging the government to ensure an open, secure, and accessible internet throughout the election period.

A statement issued by the #KeepItOn coalition in the wake of latest disruption noted that the Ethiopian government has a responsibility to protect freedom of expression and access to information rights of all persons in the country, as enshrined in its national constitution, as well as regional and international frameworks including the Universal Declaration of Human Rights, International Convention on Civil and Political Rights (ICCPR) and African Charter on Human and Peoples Rights, to which Ethiopia is a signatory. It added: “The government should be working to make sure Ethiopians connect to the internet, not the contrary.”

Almost two weeks after the disruption was initiated, reports started emerging that internet was partly restored. Digital rights advocates have noted that disruptions undermine the economic benefits of the internet, disrupt access to essential services such as health care, and often fail to meet the established test for restrictions on freedom of expression and the right of peaceful assembly under the ICCPR.

The network disruption does not help Ethiopia’s reputation which is battling to shake off its autocratic history.  The Horn of Africa country, which was due to hold parliamentary elections this August, has since postponed these plans but continues wading through political and economic reforms, some of which impact on internet access and digital rights.

A study of network disruptions in Sub-Saharan Africa showed that the less democratic a government is, the more likely it is to order an internet disruption. Both Ethiopia and Togo are characterised as authoritarian on the Economist Democracy Index.

The decision by the ECOWAS court marks a notch in the push back against internet shutdowns in Sub-Saharan Africa. Other cases against shutdowns have been lodged in various courts, including in Uganda and Cameroon, and serve as reference points for the necessity of strategic litigation in fighting network disruptions. However, judging from the experience of countries like Ethiopia, which have repeatedly disrupted networks, the strategic litigation needs to be complimented by several other efforts in fighting the scourge of shutdowns in the region and to become a thing of the past.

Togo: #KeepItOn During The Elections

The Collaboration on International ICT Policy for East and Southern Africa (CIPESA) has joined a call on the Government of Togo to keep digital communications accessible during its upcoming elections.

The country goes to the polls on February 22, 2020, marking the first presidential election since the amendment to the Constitution on term limits. The amendment capped the presidential mandate to two five-year terms. However, it would not apply retrospectively meaning that President Faure Gnassingbe, who succeeded his late father in 2005, can stand for the upcoming election, and again in 2025.  In 2017, internet access was disrupted during protests against the family’s 50-year rule of the country.

Access Now, the #KeepItOn campaign lead states that Togo should follow the footsteps of its neighbors GhanaNigeria, and Senegal who have shown that an open, secure, and accessible internet can foster civic participation during the electioneering processes and beyond, safeguard election results, and promote democracy.
