This policy brief examines Technology Facilitated Gender-Based Violence (TFGBV) as an intersecting issue of digital sexual offense, expanding beyond traditionally defined physical sexual offenses. It explicitly defines TFGBV and how it connects with sexual violence, highlighting the opportunity presented by the Sexual Offences Bill 2024 as a key policy reform to enhance prevention of both physical and digital sexual violence.

In East Africa, Kenya has over the years been regarded as a model of excellence in digital rights. However, more recently, the country has been plagued by alarming practices that threaten its standing. These include a heightened crackdown on activism, including the abduction and intimidation of activists and journalists, politically motivated internet censorship, rising disinformation, cyber threats and data breaches, and a media decline. Nonetheless, it has not been all doom and gloom as there are glimmers of hope aided by increasing internet use and a population that has displayed remarkable resilience and pushback against continued threats to digital rights.

The adoption of AI in Uganda raises significant concerns regarding the collection of personal data, particularly given the government's push for prohibitive laws affecting the digital civic space, including those that enable surveillance and internet censorship. These concerns were amplified by the recent use of AI to manipulate and influence public opinion, in a power struggle involving two officials linked to the ruling party. Accordingly, as AI technologies increasingly permeate the operations of various government agencies and private entities, such as financial institutions, Uganda faces a pressing need to develop a comprehensive national framework to govern AI.
